These Terms of Service (“Terms”) govern access to and use of the services provided by deckd UG (haftungsbeschränkt), Feurigstr. 17, 10827 Berlin, Germany (“deckd”, “we”, “us”, or “our”). By registering for, accessing, or using our services, you (“Customer”, “you”) accept and agree to be bound by these Terms.
1. Scope
These Terms apply to all contracts between deckd and Customer relating to the use of deckd’s online software-as-a-service platform (the “Services”). Differing terms of Customer do not apply, even if we do not expressly object to them. The version of these Terms in force at the time of contract conclusion applies.
2. Services
2.1 deckd provides a cloud-based platform for the creation, editing, collaboration, and distribution of presentation and brand assets. Access is provided via our webpages https://deckd.io and https://app.deckd.io.
2.2 We do not guarantee that the Services meet Customer’s specific expectations or requirements, nor do we warrant uninterrupted availability.
2.3 Customer is solely responsible for obtaining and maintaining all hardware, software, and internet connections required to access the Services.
3. User Accounts
3.1 Use of the Services requires creation of a personal user account (“Account”) through our authentication provider Clerk. Customer must provide accurate, current, and complete information and keep such information updated.
3.2 Customer must maintain the confidentiality of login credentials and is responsible for all activities that occur under its Account. Customer shall immediately notify deckd of any unauthorized use.
3.3 Accounts are individual and non-transferable. Use of the Services by persons under the age of eighteen (18) is prohibited.
4. Customer Obligations
Customer agrees not to:
(a) use another user’s Account or data;
(b) create an Account using a false identity;
(c) use the Services in violation of applicable law or to infringe rights of any third party;
(d) attempt to interfere with the proper working of the Services;
(e) transmit unsolicited advertising or spam; or
(f) upload or transmit malicious code.
5. AI-Generated Content
5.1 Certain features of the Services allow Customer to generate content using artificial intelligence models provided by Google Gemini and OpenAI (“AI Features”). Use of AI Features is optional and can be disabled by workspace administrators.
5.2 By enabling AI Features, Customer instructs deckd to transfer data input into AI fields to the respective AI sub-processor to generate content. Further information is provided in the Data Processing Addendum.
5.3 deckd does not guarantee the accuracy or suitability of AI-generated outputs. Customer remains solely responsible for verifying the content and ensuring compliance with applicable laws.
6. Paid Services, Trial, and Pricing
6.1 deckd offers paid subscription plans (Team, Pro, Enterprise). Certain features are only available with certain active subscriptions (“Paid Services”).
6.2 New Accounts receive a 14-day free trial of the Pro plan. At the end of the trial, if payment details are not provided, access to created assets and any uploaded media will be blocked until a valid subscription is activated.
6.3 Current pricing and plan details are available at https://www.deckd.io/pricing. Prices include applicable VAT unless stated otherwise. Any other taxes are borne by the Customer.
7. Payment Terms
7.1 Payments for Paid Services must be made in advance via LemonSqueezy (our payment processor). Failure to pay may result in suspension or blocking of access.
7.2 Subscriptions automatically renew at the end of each billing period (monthly or annually, depending on the selected plan), unless cancelled by the Customer prior to renewal.
7.3 The Customer may cancel the subscription at any time through their account settings. Cancellation will take effect at the end of the current billing cycle — no refunds are provided for partial billing periods.
7.4 Invoices are sent electronically to the email address associated with the Customer’s Account.
8. Term and Termination
8.1 Subscriptions for Paid Services renew automatically unless cancelled. Customer may cancel at any time via the Account interface.
8.2 New Accounts start with a 14-day free Pro trial. If no valid payment method is added by the end of the trial, access to created assets and uploaded media will be blocked until a subscription is activated.
8.3 Upon cancellation or termination of an active subscription, Customer retains access to Paid Services until the end of the pre-paid term. No refunds are issued for unused portions of a billing cycle.
8.4 Customer may delete its Account at any time. Upon deletion, access ceases immediately and deckd may permanently delete all data after thirty (30) days.
8.5 deckd may terminate the Agreement upon two (2) weeks’ written notice, or immediately for cause, including breach of these Terms or failure to make payment.
9. Intellectual Property Rights
9.1 deckd retains all intellectual property rights in and to the Services.
9.2 deckd grants Customer a non-exclusive, non-transferable right to use the Services during the term of the Agreement in accordance with these Terms.
9.3 Customer may not copy, modify, distribute, sublicense, reverse engineer, or otherwise exploit the Services except as expressly permitted.
10. Data Protection & Processing
10.1 deckd processes personal data in accordance with applicable data protection laws, notably the General Data Protection Regulation (EU) 2016/679 (“GDPR”). Details are provided in our Privacy Policy.
10.2 Where deckd processes personal data on behalf of Customer (as Processor), the Data Processing Addendum applies and forms an integral part of these Terms.

deckd may add or replace sub-processors, subject to notice to Customer and Customer’s right to object in accordance with the Data Processing Addendum.
11. Limitation of Liability
11.1 deckd is liable for damages caused by intent and gross negligence. For simple negligence, deckd is liable only for (a) injuries to life, body, or health, and (b) damages arising from the breach of essential contractual obligations, limited however to the foreseeable damages typical for this type of contract.
11.2 deckd shall not be liable for indirect, consequential, or special damages, lost profits, lost data, or business interruption.
11.3 Nothing in these Terms limits liability where liability is mandatory by law.
12. Third-Party Websites and Content
The Services may contain links to third-party services over which deckd has no control. deckd assumes no responsibility for the content, policies, or practices of third-party services.
13. Feedback
Customer may submit feedback regarding the Services. Customer grants deckd a perpetual, royalty-free right to use such feedback without further consent or compensation.
14. Amendments
deckd may amend these Terms at any time. Material amendments shall be notified to Customer at least four (4) weeks prior to coming into effect. If Customer objects, Customer may terminate the Agreement before the effective date of the changes.
15. Governing Law and Jurisdiction
These Terms are governed by the laws of the Federal Republic of Germany. The courts of Berlin shall have exclusive jurisdiction over all disputes arising out of or in connection with these Terms.
16. Severability
If any provision of these Terms is invalid, the remaining provisions shall remain unaffected.
